1. Introduction

Welcome to Sajuni.

These Hosting Terms & Conditions ("Hosting Terms") govern the hosting-related services provided by Sajuni in connection with website development, website deployment, and website hosting assistance.

Sajuni specializes in designing and developing modern websites and web applications. As part of its development services, Sajuni may assist clients with deploying websites using trusted third-party cloud hosting platforms. These Hosting Terms explain how such hosting services are provided, what responsibilities belong to Sajuni, what responsibilities belong to the client, and which matters remain under the control of third-party hosting providers.

The purpose of this document is to establish a clear understanding between Sajuni and its clients before any hosting-related services are provided. By defining the scope of responsibility in advance, both parties can avoid misunderstandings regarding hosting infrastructure, platform limitations, service availability, maintenance, and future changes made by third-party providers.

These Hosting Terms apply to every hosting-related service offered by Sajuni unless otherwise agreed in writing through a separate contract or service agreement.

These Hosting Terms should be read together with Sajuni's other applicable legal documents, including but not limited to its Website Terms & Conditions, Privacy Policy, Refund Policy, and any project-specific proposal or quotation provided to the client.

2. Definitions

For the purpose of these Hosting Terms, the following definitions shall apply unless the context requires otherwise.

2.1 "Sajuni"

"Sajuni," "we," "our," or "us" refers to Sajuni, operated by Saptashi Saha, including its website, services, support channels, and representatives.

2.2 "Client"

"Client," "Customer," or "You" refers to any individual, business, organization, startup, institution, or other entity requesting website development, hosting assistance, deployment services, maintenance, or related technical services from Sajuni.

2.3 "Hosting Services"

Hosting Services refer solely to deployment assistance, hosting configuration, domain connection, DNS setup, SSL configuration, repository integration, continuous deployment configuration, and related technical services performed by Sajuni.

Hosting Services do not mean that Sajuni owns or operates the servers on which the website is hosted.

2.4 "Hosting Provider"

A Hosting Provider is an independent third-party cloud platform that provides website hosting infrastructure.

Examples include, but are not limited to:

  • GitHub
  • Vercel
  • Cloudflare
  • Netlify

Sajuni may also use other reputable cloud hosting providers where technically appropriate for a particular project.

2.5 "Free Hosting"

Free Hosting refers to hosting services provided under the free-tier plans offered by third-party hosting providers. These plans are governed entirely by the respective provider's own policies, limitations, pricing decisions, and terms of service.

2.6 "Paid Hosting"

Paid Hosting refers to any hosting plan requiring subscription fees, usage-based charges, enterprise plans, or premium services offered directly by the hosting provider.

2.7 "Project"

Project means the website, web application, landing page, portfolio, business website, e-commerce platform, or any other digital solution developed or maintained by Sajuni.

2.8 "Deployment"

Deployment refers to the process of publishing a website from its development environment to a live hosting environment where it becomes publicly accessible through the internet.

2.9 "Domain"

Domain means the internet address associated with a website, such as:

  • example.com
  • yourbusiness.in

Domain registration and hosting are separate services unless specifically stated otherwise.

2.10 "Third-Party Services"

Third-Party Services include hosting providers, DNS providers, domain registrars, payment gateways, analytics providers, APIs, CDN providers, email providers, database providers, authentication services, and any other external services used by the project.

3. Acceptance of These Hosting Terms

By requesting, purchasing, accepting, or continuing to use any hosting-related service provided by Sajuni, the Client confirms that they have read, understood, and agreed to these Hosting Terms.

Acceptance may occur through any of the following actions:

  • Requesting hosting assistance.
  • Approving a project proposal.
  • Paying an invoice.
  • Requesting website deployment.
  • Providing hosting account access.
  • Requesting domain configuration.
  • Continuing to use hosting services after these Hosting Terms become effective.

If the Client does not agree with any provision contained in these Hosting Terms, the Client should not request or continue using hosting-related services provided by Sajuni.

The Client further agrees that these Hosting Terms may be updated periodically to reflect improvements, legal requirements, industry standards, or changes in hosting technologies. Continued use of Sajuni's hosting services after such updates constitutes acceptance of the revised Hosting Terms.

4. Hosting Service Overview

Sajuni provides website development services together with technical assistance for deploying completed websites to reliable cloud hosting platforms.

Unless explicitly agreed otherwise in writing, Sajuni does not own, lease, or operate physical servers, cloud infrastructure, or data centers used for hosting client websites.

Instead, Sajuni assists clients by configuring and deploying websites using professional cloud hosting platforms selected according to the technical requirements of each project.

Hosting assistance may include services such as:

  • Website deployment
  • Repository configuration
  • Continuous deployment setup
  • SSL configuration
  • Domain connection
  • DNS configuration
  • Build configuration
  • Environment variable setup
  • Performance optimization
  • Basic deployment troubleshooting
  • Website migration (where applicable)

The exact scope of hosting assistance depends on the project proposal, quotation, or service agreement accepted by the Client.

Unless specifically included within the agreed project scope, ongoing website maintenance, monitoring, security management, performance optimization, content updates, and technical support are not included as permanent services.

5. Third-Party Hosting Providers

To provide reliable website deployment, Sajuni may utilize reputable third-party cloud hosting providers.

Depending on the technical requirements of a project, Sajuni may deploy websites using platforms including, but not limited to:

  • GitHub
  • Vercel
  • Cloudflare
  • Netlify

Sajuni may also recommend or use other established hosting providers if they are better suited for a particular project's technical, performance, or security requirements.

These providers are independent companies with their own:

  • Terms of Service
  • Privacy Policies
  • Acceptable Use Policies
  • Security Policies
  • Pricing Structures
  • Free and Paid Hosting Plans
  • Infrastructure Management
  • Service Availability
  • Operational Procedures

The Client acknowledges that Sajuni has no ownership, management authority, or control over these providers or their infrastructure.

Accordingly, Sajuni cannot guarantee or influence:

  • Platform uptime
  • Server availability
  • Network performance
  • Infrastructure changes
  • Pricing decisions
  • Service interruptions
  • Platform maintenance schedules
  • Feature availability
  • Storage limits
  • Bandwidth limits
  • Build limits
  • API limits
  • Regional availability
  • Business decisions made by the hosting provider

All such matters remain solely under the responsibility and control of the respective hosting provider.

6. Free Hosting Policy

For many projects, Sajuni may recommend or assist in deploying websites using free-tier hosting plans made available by third-party hosting providers.

Free hosting offers an economical solution for portfolios, personal websites, startup projects, prototypes, landing pages, and many small to medium-sized websites.

However, the Client understands and agrees that free hosting plans are provided exclusively by the respective hosting providers and not by Sajuni.

As a result, free hosting may include limitations such as:

  • Monthly bandwidth limits
  • Storage limitations
  • Build minute limitations
  • Serverless execution limits
  • Function execution limits
  • Image optimization limits
  • API request limitations
  • Repository limitations
  • Team collaboration restrictions
  • Regional restrictions
  • Performance limitations
  • Fair usage restrictions

These limitations may change at any time without prior notice from Sajuni.

The Client further understands that hosting providers may:

  • Modify their free plans.
  • Reduce available resources.
  • Introduce new restrictions.
  • Discontinue certain features.
  • Require paid subscriptions.
  • Remove free hosting entirely.
  • Change eligibility requirements.
  • Update their infrastructure.

Such decisions are made independently by the hosting providers and are entirely outside Sajuni's control.

Sajuni shall not be responsible for any financial costs, subscription fees, service interruptions, migration requirements, or project modifications resulting from future policy changes made by any hosting provider.

Should a project eventually require migration to a paid hosting plan due to increased traffic, business growth, technical requirements, or changes to the provider's free-tier offerings, the Client shall be solely responsible for any applicable subscription or usage charges unless otherwise agreed in writing.

7. Client Eligibility

Hosting services provided by Sajuni are intended for legitimate individuals, businesses, organizations, startups, educational institutions, non-profit entities, and other lawful users seeking professional website deployment services.

By requesting hosting assistance, the Client confirms that:

  • They have the legal authority to enter into this agreement.
  • The information provided to Sajuni is accurate and complete.
  • They are authorized to manage or use any domain names, repositories, or hosting accounts supplied for the project.
  • They will comply with all applicable laws and regulations.
  • They will comply with the applicable terms and policies of the selected hosting provider.
  • They will not use the hosted website for unlawful, fraudulent, deceptive, malicious, or abusive activities.
  • They understand that Sajuni reserves the right to decline hosting assistance for projects that violate applicable laws, platform policies, or accepted ethical standards.

Sajuni may refuse, suspend, or discontinue hosting assistance where a project involves illegal content, malware distribution, phishing, spam, copyright infringement, unauthorized access attempts, harmful software, or any activity that may expose Sajuni or the hosting provider to legal, operational, or security risks.

8. Account Ownership

8.1 General Principle

Sajuni strongly recommends that all hosting-related accounts be created and owned directly by the Client whenever possible. This approach ensures that the Client maintains full ownership and long-term control over their website, hosting infrastructure, repositories, domains, DNS settings, and associated services.

Unless otherwise agreed in writing, Sajuni does not claim ownership of any client-owned hosting account or associated digital assets.

8.2 Client-Owned Accounts

Where practical, the Client should create and maintain their own accounts for services including, but not limited to:

  • GitHub
  • Vercel
  • Cloudflare
  • Netlify
  • Domain Registrar
  • Email Services
  • Analytics Services
  • Third-party APIs

The Client remains solely responsible for:

  • Account registration
  • Password management
  • Two-factor authentication (2FA)
  • Recovery email addresses
  • Security questions
  • Subscription management
  • Billing information
  • Account recovery procedures

8.3 Temporary Access

To perform deployment or configuration work, the Client may grant Sajuni temporary administrative or collaborator access to their accounts.

Such access shall be used exclusively for completing the requested technical work.

Upon completion of the project, the Client is encouraged to review permissions and remove or adjust access as appropriate.

8.4 Accounts Created by Sajuni

In certain situations, Sajuni may create accounts on behalf of the Client for project convenience.

Where this occurs:

  • the account is intended solely for the Client's project,
  • ownership will be transferred to the Client whenever reasonably possible,
  • the Client is expected to update passwords and recovery information promptly after handover.

Sajuni reserves the right to decline creating personal accounts for Clients where platform policies require individual ownership.

8.5 Ownership of Digital Assets

Unless otherwise agreed in writing, the Client retains ownership of:

  • domain names purchased by the Client,
  • client-owned hosting accounts,
  • client-owned repositories,
  • website content,
  • logos,
  • images,
  • business information,
  • uploaded files.

Ownership of custom source code, templates, reusable components, licensed assets, or proprietary development frameworks shall be governed by the applicable project agreement or service contract.

9. GitHub Repository Management

9.1 Repository Usage

For many modern web development projects, Sajuni may use GitHub as a version control platform for managing source code.

GitHub allows secure storage of project files, version history, collaboration, and automated deployment workflows.

9.2 Repository Ownership

Whenever practical, repositories should be created under the Client's GitHub account.

If a repository is initially created under Sajuni's account for development purposes, ownership or appropriate access may be transferred according to the agreed project scope.

9.3 Repository Access

Depending on project requirements, Sajuni may request:

  • Collaborator access
  • Organization access
  • Repository permissions
  • Deployment permissions

Only the minimum permissions reasonably required to complete the requested work should be granted.

9.4 Source Code History

Git commit history, branches, releases, pull requests, and deployment workflows may be maintained throughout development.

Modification or deletion of repository history by the Client after project delivery may affect future maintenance or troubleshooting.

9.5 Repository Security

The Client is responsible for protecting repository access credentials and ensuring that unauthorized individuals are not granted administrative permissions.

Sajuni is not responsible for unauthorized changes made by third parties after project delivery.

10. Vercel Deployment

10.1 Purpose

Sajuni frequently deploys modern web applications using Vercel due to its optimized support for frameworks such as Next.js and other contemporary frontend technologies.

The choice of deployment platform may vary depending on project requirements.

10.2 Deployment Assistance

Deployment services may include:

  • project import,
  • repository linking,
  • framework configuration,
  • environment variables,
  • build configuration,
  • production deployment,
  • custom domain connection,
  • SSL activation,
  • deployment verification.

10.3 Free Plan Limitations

When a project is deployed using Vercel's free-tier services, the Client acknowledges that available resources are determined solely by Vercel.

These resources may include limitations relating to:

  • bandwidth,
  • build executions,
  • serverless functions,
  • edge functions,
  • image optimization,
  • storage,
  • usage quotas,
  • request limits.

These limitations may change without notice from Sajuni.

10.4 Platform Changes

Vercel may modify its:

  • pricing,
  • features,
  • usage policies,
  • free plans,
  • infrastructure,
  • supported technologies,
  • deployment limits,

at any time.

Such changes remain entirely outside Sajuni's control.

11. Cloudflare Services

11.1 Scope

Cloudflare may be used for services including:

  • DNS management,
  • CDN configuration,
  • SSL services,
  • caching,
  • performance optimization,
  • security enhancements,
  • domain management.

Use of Cloudflare depends upon the specific requirements of each project.

11.2 DNS Management

Where Cloudflare DNS is configured, DNS propagation times may vary depending on internet infrastructure and registry updates.

Sajuni cannot guarantee immediate DNS propagation worldwide.

11.3 Security Features

Cloudflare provides numerous security features including protection against certain network attacks.

However, no security service can guarantee complete protection against every cyber threat.

Accordingly, Sajuni does not warrant that use of Cloudflare will eliminate all security risks.

11.4 Platform Availability

Cloudflare independently manages its own infrastructure, network, services, and operational policies.

Sajuni shall not be responsible for outages, maintenance events, infrastructure failures, or operational decisions affecting Cloudflare services.

12. Netlify Deployment

12.1 Deployment Scope

Certain projects may be deployed using Netlify where technically appropriate.

Deployment services may include:

  • Git integration,
  • build configuration,
  • environment variables,
  • deployment settings,
  • custom domains,
  • SSL configuration,
  • form configuration,
  • redirect configuration.

12.2 Platform Limitations

Netlify independently determines:

  • free plan availability,
  • bandwidth limits,
  • build minutes,
  • storage,
  • deployment frequency,
  • pricing,
  • usage restrictions.

These matters remain solely under Netlify's control.

12.3 Future Changes

The Client understands that Netlify may modify its platform, discontinue features, introduce paid requirements, or revise service limitations at any time.

Such decisions are independent business decisions made exclusively by Netlify.

13. Domain Ownership

13.1 Separate Service

Domain registration and website hosting are separate services.

Purchasing a domain does not automatically include hosting.

Similarly, hosting a website does not automatically include domain registration.

13.2 Client Responsibility

Unless otherwise agreed in writing, the Client is responsible for:

  • purchasing domain names,
  • renewing domain registrations,
  • maintaining registrar accounts,
  • keeping registration information current,
  • ensuring payment of renewal fees.

Failure to renew a domain may result in website interruption or permanent loss of the domain name.

13.3 Registrar Policies

Domains are governed by the policies of the selected domain registrar.

Sajuni has no authority over registrar pricing, transfers, suspensions, expirations, redemption procedures, or renewal policies.

13.4 Domain Transfers

Where domain transfers are requested, the Client shall cooperate by providing the necessary authorization codes, approvals, and account access required by the registrar.

Transfer timelines are determined by registrar procedures rather than Sajuni.

14. DNS Management

14.1 Configuration

Sajuni may assist with configuring DNS records necessary for website deployment.

These may include:

  • A Records
  • AAAA Records
  • CNAME Records
  • TXT Records
  • MX Records
  • Redirects
  • Verification Records

depending upon project requirements.

14.2 DNS Propagation

Changes to DNS records require global propagation across internet infrastructure.

Propagation times vary considerably and may range from several minutes to 48 hours or longer.

Such propagation delays are normal and outside Sajuni's control.

14.3 Client Responsibilities

The Client remains responsible for maintaining access to:

  • domain registrar accounts,
  • DNS provider accounts,
  • authentication credentials,
  • account recovery information.

15. SSL Certificates

15.1 SSL Availability

Where supported by the hosting provider, Sajuni may assist in enabling SSL certificates for secure HTTPS connections.

Many modern hosting platforms automatically issue SSL certificates.

15.2 Third-Party Control

SSL certificates are generally issued, renewed, and managed by third-party providers.

Accordingly, Sajuni cannot guarantee uninterrupted certificate issuance or renewal.

15.3 HTTPS Availability

Temporary interruptions to HTTPS services may occur due to:

  • DNS changes,
  • certificate validation,
  • platform maintenance,
  • infrastructure changes,
  • provider outages.

Such events are beyond Sajuni's reasonable control.

16. Website Deployment Process

16.1 Development Completion

Deployment normally begins after the Client has approved the completed website or project milestone.

16.2 Deployment Activities

Deployment may include:

  • source code preparation,
  • repository synchronization,
  • production build,
  • hosting configuration,
  • domain connection,
  • SSL activation,
  • environment variable configuration,
  • deployment verification,
  • post-deployment testing.

The exact deployment process may vary depending on the technologies and hosting provider selected for the project.

16.3 Client Cooperation

To complete deployment efficiently, the Client agrees to provide any reasonably required information or access, including account invitations, DNS permissions, verification approvals, or domain management access.

Delays in providing requested information may postpone deployment timelines.

16.4 Acceptance of Deployment

A deployment shall generally be considered complete once the website is successfully published and reasonably accessible through its designated production URL, subject to normal DNS propagation and third-party infrastructure availability.

Minor adjustments, optimization requests, or future enhancements requested after deployment may be treated as separate work unless expressly included within the original project scope.

17. Client Responsibilities

17.1 General Responsibilities

The Client plays an essential role in ensuring the successful deployment, operation, and ongoing management of the hosted website. While Sajuni provides professional development and deployment assistance, the long-term operation of the website also depends upon the Client's cooperation and compliance with these Hosting Terms.

The Client agrees to act responsibly and provide timely assistance whenever reasonably required for the completion or maintenance of the project.

17.2 Accurate Information

The Client agrees to provide complete, accurate, and up-to-date information necessary for website deployment and hosting, including but not limited to:

  • Business information
  • Contact information
  • Domain details
  • Hosting account details
  • Repository access
  • DNS permissions
  • Project requirements
  • Technical preferences

The Client is responsible for informing Sajuni of any changes to this information that may affect the website or hosting services.

17.3 Account Security

The Client shall maintain the confidentiality of all login credentials associated with their:

  • GitHub account
  • Hosting provider accounts
  • Domain registrar accounts
  • DNS provider accounts
  • Email accounts
  • Third-party services

Passwords, recovery information, authentication devices, and two-factor authentication methods should be protected against unauthorized access.

17.4 Cooperation During Deployment

The Client agrees to provide reasonable cooperation during deployment, including responding to requests for approvals, verification emails, access invitations, DNS confirmations, or other technical requirements.

Failure to provide timely cooperation may delay project delivery or deployment.

17.5 Compliance with Applicable Laws

The Client agrees that the website and its content shall comply with all applicable laws, regulations, and governmental requirements within the jurisdictions in which the website operates.

17.6 Responsibility for Website Content

Unless specifically agreed otherwise, the Client is solely responsible for all content published on the website, including but not limited to:

  • Text
  • Images
  • Videos
  • Documents
  • Downloads
  • Logos
  • Trademarks
  • Product information
  • Pricing
  • Blog articles
  • User-generated content

The Client represents that they have the necessary rights, permissions, or licenses to use such content.

18. Acceptable Use Policy

18.1 Lawful Use

Hosting services provided through Sajuni shall be used only for lawful purposes.

The Client agrees not to use the website or hosting infrastructure for activities that violate applicable laws, regulations, or the policies of the selected hosting provider.

18.2 Prohibited Activities

The Client shall not knowingly use the hosted website to engage in activities including, but not limited to:

  • Distribution of malware or malicious software
  • Phishing or identity theft
  • Spam or unsolicited bulk communications
  • Copyright infringement
  • Trademark infringement
  • Distribution of pirated content
  • Fraudulent activities
  • Unauthorized access to computer systems
  • Circumvention of security controls
  • Cryptocurrency mining without authorization
  • Distribution of ransomware
  • Botnet operation
  • Illegal gambling
  • Sale or promotion of prohibited goods or services
  • Hosting harmful or deceptive software
  • Activities that intentionally disrupt internet services

18.3 Offensive or Illegal Content

The Client shall not publish or distribute content that is unlawful, defamatory, abusive, fraudulent, hateful, or otherwise prohibited under applicable law or by the hosting provider's policies.

18.4 Compliance with Platform Policies

The Client acknowledges that all hosting providers maintain their own acceptable use policies.

Where a conflict exists between the Client's intended use and the hosting provider's policies, the provider's policies shall govern the use of its platform.

18.5 Right to Decline Assistance

Sajuni reserves the right to refuse deployment, suspend technical assistance, or discontinue hosting-related services if the Client's project is reasonably believed to violate applicable laws, these Hosting Terms, or the policies of the relevant hosting provider.

19. Website Security

19.2 No Absolute Security Guarantee

Despite reasonable precautions, no website, server, application, network, or online service can be guaranteed to be completely secure.

Accordingly, Sajuni does not guarantee that any website will be:

  • Hack-proof
  • Virus-free
  • Malware-free
  • Immune from cyberattacks
  • Free from security vulnerabilities
  • Protected against all unauthorized access attempts

19.3 Client Security Responsibilities

The Client is responsible for maintaining appropriate security practices, including:

  • Multi-factor authentication where available

  • Careful management of administrator accounts
  • Timely review of account permissions
  • Safe handling of confidential credentials

19.4 Third-Party Vulnerabilities

Many websites rely on third-party libraries, frameworks, APIs, plugins, or external services.

Sajuni cannot guarantee the continued security of third-party software that is independently maintained by external developers or service providers.

19.5 Security Incidents

If Sajuni becomes aware of a security issue affecting work under its control, reasonable efforts will be made to notify the Client and provide appropriate technical assistance within the agreed scope of services.

20. Data Backup Policy

20.1 Importance of Backups

The Client acknowledges that maintaining reliable backups is an essential part of responsible website management.

20.2 Client Responsibility

Unless expressly included within a separate maintenance agreement, the Client remains primarily responsible for maintaining backups of:

  • Website files
  • Databases
  • Media uploads
  • Configuration files
  • Source code
  • Environment settings
  • Business data

20.3 Backup Assistance

Where requested, Sajuni may assist with backup configuration or backup restoration.

Such assistance does not create an ongoing obligation to maintain continuous or permanent backups.

20.4 No Guaranteed Recovery

Although reasonable care may be taken during development and deployment, Sajuni cannot guarantee recovery of data lost due to:

  • Hardware failures
  • Hosting provider failures
  • Human error
  • Client actions
  • Third-party software failures
  • Cybersecurity incidents
  • Accidental deletion
  • Natural disasters

20.5 Backup Verification

Clients are encouraged to periodically verify that backups are complete, accessible, and capable of successful restoration.

21. Resource Limits

21.1 Hosting Resources

All hosting resources are provided according to the limits established by the selected hosting provider.

These resources may include:

  • CPU allocation
  • Memory allocation
  • Storage capacity
  • Bandwidth
  • Build minutes
  • Serverless execution
  • Function invocations
  • Database usage
  • Network traffic
  • File storage

21.2 Usage Monitoring by Providers

Hosting providers may automatically monitor resource consumption and enforce limitations according to their own policies.

Such actions may include:

  • Temporary throttling
  • Request limitations
  • Suspension of services
  • Additional charges
  • Requirement to upgrade to paid plans

These actions are determined solely by the hosting provider.

21.3 Growth of the Website

As websites grow in popularity, traffic, storage requirements, or functionality, additional hosting resources may become necessary.

The Client acknowledges that future growth may require migration to higher-tier hosting services.

22. Technical Support

22.1 Scope of Support

Technical support provided by Sajuni is limited to the services agreed upon in the applicable project proposal, quotation, maintenance agreement, or support plan.

22.2 Support Channels

Clients may contact Sajuni through the official support channels published on the website.

Support requests should include sufficient information to allow efficient investigation of the reported issue.

22.3 Response Times

While Sajuni aims to respond promptly during normal business hours, response times may vary depending upon:

  • Workload
  • Issue complexity
  • Availability of third-party providers
  • Required investigation
  • Public holidays
  • Weekends

Unless expressly agreed otherwise, no guaranteed response time or service-level agreement (SLA) is provided.

22.4 Third-Party Issues

Where an issue originates from a third-party hosting provider, registrar, CDN, DNS provider, or other external service, Sajuni may assist with troubleshooting but cannot guarantee resolution timelines, as the final resolution remains dependent upon the respective provider.

23. Website Maintenance

23.1 Separate Service

Website maintenance is separate from website development and deployment unless explicitly included within the agreed project scope.

23.2 Maintenance Activities

Where maintenance services are purchased, they may include services such as:

  • Minor content updates
  • Dependency updates
  • Bug fixes
  • Configuration adjustments
  • Performance improvements
  • Basic security reviews
  • Deployment assistance

The exact maintenance scope shall be determined by the applicable maintenance agreement.

23.3 Exclusions

Unless expressly agreed otherwise, maintenance services do not automatically include:

  • Major redesigns
  • New feature development
  • Complete platform migrations
  • Third-party software development
  • Emergency recovery after unauthorized client modifications
  • Recovery from unsupported customizations

24. Monitoring & Service Availability

24.1 Monitoring

Unless specifically included within a separate managed hosting or maintenance agreement, Sajuni does not provide continuous 24/7 monitoring of hosted websites.

The Client is encouraged to monitor the availability and performance of their website using suitable monitoring tools where appropriate.

24.2 Service Availability

Website availability depends upon numerous factors beyond Sajuni's reasonable control, including:

  • Hosting provider infrastructure
  • DNS propagation
  • Internet connectivity
  • Regional network conditions
  • Cloud platform availability
  • Third-party services
  • Scheduled maintenance
  • Emergency maintenance

Accordingly, Sajuni does not guarantee uninterrupted or error-free website availability.

24.3 Planned Maintenance

Hosting providers may periodically perform scheduled maintenance that could temporarily affect website accessibility.

Such maintenance schedules are determined by the respective provider and are outside Sajuni's control.

24.4 Incident Assistance

Where reasonably possible and within the agreed scope of services, Sajuni may assist the Client in identifying the probable cause of service interruptions and recommending appropriate corrective actions.

However, Sajuni cannot guarantee restoration times where the interruption originates from third-party infrastructure or services.

25. Limitation of Liability

25.1 Scope of Liability

Sajuni provides professional website development and deployment assistance using commercially reasonable care and industry-recognized practices. However, due to the nature of internet infrastructure and reliance on independent third-party service providers, Sajuni cannot guarantee uninterrupted availability, error-free operation, or permanent accessibility of any hosted website.

To the fullest extent permitted by applicable law, Sajuni's liability shall be limited solely to the services directly provided by Sajuni and shall not extend to circumstances beyond its reasonable control.

25.2 No Liability for Third-Party Infrastructure

Sajuni shall not be responsible or liable for any loss, interruption, damage, or inconvenience arising directly or indirectly from:

  • Hosting provider outages
  • Domain registrar failures
  • DNS provider issues
  • Cloud infrastructure failures
  • CDN outages
  • API failures
  • Third-party software defects
  • Internet service provider interruptions
  • Government restrictions affecting online services
  • Platform maintenance performed by third-party providers

25.3 Business Losses

To the maximum extent permitted by law, Sajuni shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to:

  • Loss of revenue
  • Loss of profits
  • Loss of business opportunities
  • Loss of customers
  • Loss of goodwill
  • Loss of contracts
  • Loss of reputation
  • Business interruption

  • Production delays

whether arising in contract, tort, negligence, or otherwise.

25.4 Client Responsibility

The Client acknowledges that operating an online website involves inherent technical and business risks. The Client accepts responsibility for maintaining appropriate business continuity plans, backups, insurance (where applicable), and contingency measures.

25.5 Maximum Liability

Where liability cannot legally be excluded, Sajuni's maximum aggregate liability relating to hosting services shall not exceed the amount actually paid by the Client to Sajuni for the specific hosting-related service giving rise to the claim, unless otherwise required by applicable law.

26. Service Interruptions & Force Majeure

26.1 Service Interruptions

Website availability may occasionally be affected by circumstances beyond Sajuni's reasonable control.

Examples include:

  • Hosting platform outages
  • DNS propagation delays
  • SSL certificate validation delays
  • Internet routing issues
  • Scheduled maintenance
  • Emergency maintenance
  • Infrastructure upgrades
  • Hardware failures
  • Software failures
  • Power disruptions
  • Regional network failures

Such interruptions do not constitute a breach of these Hosting Terms.

26.2 Force Majeure

Sajuni shall not be liable for any delay, interruption, or failure to perform its obligations where such failure results from events beyond its reasonable control, including but not limited to:

  • Natural disasters
  • Floods
  • Earthquakes
  • Fires
  • Storms
  • Pandemics
  • Epidemics
  • War
  • Terrorist activities
  • Civil unrest
  • Government actions
  • Legal restrictions
  • Cyberattacks affecting infrastructure
  • Widespread internet outages
  • Cloud provider disruptions
  • Labor disputes
  • Utility failures

Performance shall resume as soon as reasonably practicable once the relevant circumstances have ended.

27. Third-Party Platform Policy Changes

27.1 Independent Platform Decisions

The Client acknowledges that all hosting providers operate independently of Sajuni.

Accordingly, GitHub, Vercel, Cloudflare, Netlify, or any other third-party service provider may modify their:

  • Terms of Service
  • Privacy Policies
  • Pricing
  • Free plans
  • Paid plans
  • Infrastructure
  • Product features
  • Resource limits
  • Security requirements
  • Account policies
  • Fair usage policies
  • Service availability

at any time without prior notice to Sajuni.

27.2 No Control Over Platform Policies

Sajuni has no authority to influence or override any decision made by a third-party hosting provider.

Any policy updates implemented by such providers shall automatically remain subject to the respective provider's own legal documentation.

27.3 Client Responsibility

The Client is encouraged to periodically review the latest policies published by the third-party providers used for their project.

Continued use of those services constitutes acceptance of the applicable provider's terms.

28. Paid Hosting Upgrades

28.1 Future Growth

As websites expand in traffic, storage requirements, business operations, or technical complexity, the free-tier hosting plans initially selected may no longer be suitable.

In such cases, migration to a paid hosting plan may become necessary.

28.2 Upgrade Responsibility

Unless expressly agreed otherwise in writing, all future costs relating to:

  • Paid hosting subscriptions
  • Premium platform plans
  • Additional bandwidth
  • Increased storage
  • Advanced security services
  • Enterprise hosting
  • Additional server resources
  • Third-party subscriptions

shall be the sole responsibility of the Client.

28.3 Upgrade Assistance

Where requested, Sajuni may assist the Client in upgrading, migrating, or reconfiguring hosting environments.

Such work may be treated as a separate billable service unless already included within an applicable maintenance or support agreement.

29. Intellectual Property

29.1 Client-Owned Content

The Client retains ownership of all original content supplied for the website, including but not limited to:

  • Company information
  • Logos
  • Images
  • Videos
  • Product descriptions
  • Marketing materials
  • Documents
  • Trademarks
  • Copyrighted materials owned by the Client

The Client warrants that they possess all necessary rights to provide such content.

29.2 Sajuni Development Work

Ownership and licensing of custom-developed source code, reusable components, templates, design systems, utilities, internal development frameworks, or proprietary implementation methods shall be governed by the applicable project agreement or written contract between Sajuni and the Client.

29.3 Third-Party Software

Many websites incorporate open-source software, third-party libraries, fonts, APIs, frameworks, plugins, or external services.

Such software remains subject to the licenses and terms established by their respective owners.

Nothing contained within these Hosting Terms transfers ownership of third-party intellectual property.

30. Governing Law & Dispute Resolution

30.1 Applicable Law

These Hosting Terms shall be governed by and interpreted in accordance with the applicable laws of the Republic of India, without regard to conflict of law principles.

30.2 Good Faith Resolution

Before commencing formal legal proceedings, both Sajuni and the Client agree to make reasonable efforts to resolve disputes through good faith discussions and mutual cooperation.

30.3 Jurisdiction

Subject to applicable law, any dispute that cannot be resolved amicably shall be subject to the competent courts having jurisdiction over Sajuni's principal place of business.

Nothing in this section shall limit any statutory rights that cannot legally be excluded.

These Hosting Terms & Conditions become effective on the Effective Date specified at the beginning of this document and remain in force until replaced by a revised version published by Sajuni.

34. Final Provisions

These Hosting Terms constitute the complete understanding between Sajuni and the Client regarding hosting-related services unless supplemented by a separate written agreement.

If any provision of these Hosting Terms is determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Any failure by Sajuni to enforce a particular provision of these Hosting Terms shall not constitute a waiver of that provision or of any other rights available under applicable law.
